Bambee delivers HR outsourcing services that allow companies to do what they do best. As their trusted HR advisor, Bambee helps these employers contain HR costs, minimize employer-related risk and relieve the administrative burden of HR. In order for Bambee to provide this vast array of services to its customers and their worksite employees, Bambee must collect certain personal information regarding the employees of its customers. It is, therefore, an essential part of Our Service that information You submit through the Service be made available to us, other Users, and certain third parties as set forth herein. Your information may also be shared with other Bambee Services of which You are not a User, as well as potentially transmitted to third-parties, such as payroll, time and attendance, and other third parties, as set forth herein and in our Terms of Service. Bambee is committed to protecting the privacy of its Users and the information that You share in connection with Your use of Bambee’s Services. This Privacy Notice describes how We collect, use, share, transfer, and disclose Your Personal Information.
This Privacy Notice applies to information We collect when You access and/or use Our Services. Bambee may provide additional notices through Our Services in addition to these practices or provide You additional choices about how Bambee may process Your Personal Information. By submitting information, including Personal Information, through Our Services, You agree to the terms of this Privacy Notice and following Policy (collectively, the “Privacy Policy”), as well as Our Terms of Service located at the following link https://www.bambee.com/legal/tos, Our Cookie Policy located at the following link https://www.bambee.com/legal/cookie-policy, and any other policies found here https://www.bambee.com/legal/ or referenced therein. If You do not agree to all of these terms, conditions, and policies, You should discontinue use of the Services immediately.
This policy does not apply to any information that you may provide directly to third parties including via embedded or integrated services, and any third-party sites linked to the Bambee.com Website or Bambee’s service Websites, except in the event Bambee’s responsibility or liability cannot be excluded by law in which case this privacy policy will continue to apply solely with respect to Bambee and not our third parties. While Bambee actively seeks to ensure that its suppliers and service providers maintain high standards regarding the protection of personal information collected on their Websites, Bambee is not responsible for the privacy practices employed by such sites.
PLEASE BE AWARE THAT BAMBEE AND ALL ASSOCIATED SERVICES AND SYSTEMS ARE HOUSED ON SERVERS IN THE UNITED STATES AND THE SERVICES ARE INTENDED TO BE USED IN THE UNITED STATES. IF YOU ARE LOCATED OUTSIDE OF THE UNITED STATES, INFORMATION WE COLLECT (INCLUDING COOKIES) ARE PROCESSED AND STORED IN THE UNITED STATES, WHICH MAY NOT OFFER THE SAME LEVEL OF PRIVACY PROTECTION AS THE COUNTRY WHERE YOU RESIDE OR ARE A CITIZEN. BY USING THE SERVICES AND PROVIDING INFORMATION TO US, YOU CONSENT TO THE TRANSFER TO AND PROCESSING OF THE INFORMATION IN THE UNITED STATES.
2. Changes to this Privacy Policy
We may change the provisions of this Privacy Policy at any time and for any reason, and will indicate when changes have been made by revising the date at the top of this Privacy Privacy. We encourage You to review this Privacy Policy whenever You access Services to make sure that You understand Our information collection, use, and disclosure practices. When We make material changes to this Privacy Policy, We will provide You with prominent notice as appropriate under the circumstances, e.g., by displaying a prominent notice within the Service or by sending You an email. We may notify You in advance. You are ultimately responsible for consulting this Privacy Policy regularly for any changes. Continued use of Our Services shall indicate Your acknowledgement of such changes and agreement to be bound by the terms of such changes. If You do not agree, You should immediately discontinue Your use of the Services.
3. Categories of Personal Information
Personal Information is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. We, Bambee, will never sell, rent, lend or trade this information in our possession to any other company for the purpose of contacting you regarding commercial services. If You are a Bambee customer or worksite employee of a customer, we collect the information necessary to provide our services, collecting it either from You directly or from Your worksite Employer. This collection is limited to the purpose of providing the service for which You have engaged Bambee. By voluntarily providing information or by accessing Our Websites, You consent to the collection, use and disclosure of Your personally identifiable information in accordance with this Privacy Policy.
The following are Personal Information categories of data that We may collect from You:
- Contact Information and identifiers. Name, postal address, unique personal identifier, telephone number, online identifier, Internet Protocol address, email address, social security number, company name or similar information.
- Financial Information. Social security number, taxpayer identification number, salary, benefits, dependent information, Bank account number, credit card number, debit card number, other financial information.
- Protected Classification Information. Gender, national origin, disability, and/or age.
- Transaction Information. Information related to transactions made through Services.
- Personal Network Information. Browsing history, search history, information regarding Your interaction with the Services and advertisements, internet protocol addresses, internet service provider, referring/exit pages, operating system, clickstream, and other generally accepted network data.
- Geolocation Data. Mailing address or billing address.
- Visual, audio, olfactory, electronic, or similar data. Physical characteristics or description, video or photos You choose to share.
- Professional Information. Employer name and employment history.
- Customer Records. Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)), such as name, signature, address, telephone number, social security number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, medical information, or health insurance information. Some personal information included in this category may overlap with other categories.
- Commercial Information. Such as records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
- Inferences from the foregoing categories. Additional demographic information reflecting Your preferences and characteristics.
Personal Information may also contain third-party personally identifiable information You provide to Bambee through Your use of the Service(s), of which You remain liable for at all times. Aggregated, non-personally identifying information is not Your Personal Information. We may use aggregated, non-personally identifying information to operate, analyze, improve, and optimize Services.
When You download and/or use our services, We automatically collect information on the type of device You use, operating system version and the device identifier (or "UDID").
We may link together different types of information or link information to personal data. If linked information directly or indirectly identifies an individual person, We treat the linked information as personal data. In this Privacy Policy, to “process” personal data means to perform any operation on Personal Data, whether or not by automated means, such as collection, recording, organizing, storing, adapting, use, disclosure, combining, erasing or destroying. Where We need to collect personal data by law, or under the terms of the contract between us and You do not provide that data when requested, We may not be able to perform the contract we have or are trying to enter into with you (for example, to provide You with products or Services). In this case, We may have to cancel a product or service You have with us but We will notify you if this is the case.
4. Sources of Information
- When You register for the Services. When You register for the Services, We collect Your user name (which may also be your email address), email address, and password.
- When Accessing and Using Services. If You are a customer (also referred to as an Employer) or Employee serviced by Bambee, in connection with the provision of the Services We may collect and maintain personally identifiable information including, but not limited to, name, address, phone number, Social Security number, taxpayer identification number, age, marital status, occupation, salary, benefits, dependent information, etc. through Bambee Services or other means disclosed to You. This information will be used to provide our HR-related services, which may include sharing such information with your worksite employer to the extent permitted by applicable law.
- Social Media Platforms. If You contact Us through Our Facebook, Instagram, LinkedIn, Twitter or another similar service (“Social Media Platform”), We may have access to the profile information associated with Your Social Media Platform account. We may also be able to access information contained in Cookies placed on the device used to access and use the applicable Social Media Platform. “Cookies” are text-only pieces of information that a website transfers to an individual’s hard drive or other website-browsing equipment for record-keeping purposes. Cookies allow Services to remember important information that will make Your use of Services more convenient. Please refer to our Cookie Policy for further information.
- Personal Network Information and Log Data. We also collect Your public IP address when You visit or access Our Services. We may use Your public IP address in order to determine whether certain requests are fraudulent or frivolous and We may automatically cross-reference Your public IP address with Your domain name. When accessing Services from Your personal network, Your IP address and any associated domain name will be treated as Your “Personal Network Information”. “Log Data” does not include Personal Network Information.
- Payments Data. If You make a payment to Bambee, We will ask for payment information and other information requested for processing Your payment. We use a third party payment processor, which is currently Stripe, to assist with securely processing your payment information. If You pay with a credit card, the payment information that You provide through the Services is encrypted and transmitted directly to Stripe. We do not store your payment information and do not control and are not responsible for Stripe or its collection or use of your information. You may find out more about how Stripe stores and uses your payment information by accessing the Privacy Policy for Stripe’s Services (see https://stripe.com/privacy).
- Things Others Do and Information They Provide About You. We also receive and analyze communications and information from other Users related to Your use of Services. This can include information about Your performance and your ability to meet the obligations associated with a potential hiring arrangement.
- When You communicate with Us. When You email, call, text, or use the website chat feature we may collect your name, contact information, and other details you provide to us in connection with the communication. Telephone calls may be recorded for quality assurance and training purposes, as well as shared with Employers or Employees upon request or through legal or governmental authority, request, claim, or action. We use third party chat service providers, currently Intercom and ServiceCloud (“Chat Providers”). Chat Providers may store Your contact information and a transcript of Your chat session with Us, including any personal information You may provide. You may find out more about how Our Chat Providers store and use Your information by accessing the Privacy Policy for the Chat Providers’ Services (see Intercom: https://www.intercom.com/legal/privacy and ServiceCloud: https://www.salesforce.com/company/privacy/).
- Employee Report Card or Voices Feature. Your Employer may submit a performance grade and feedback regarding Your Employment through the Services (“Employee Report Cards”). Only You, administrators designated by your employer, and Bambee personnel (for customer service purposes) may access and view your Employee Report Card. You may also have the option to enter open text comments and opinions regarding Your employer and employment through the Services (“Employee Voices”). You may choose whether your comments and opinions submitted through Employee Voices are identifiable (i.e., submitted in connection with your personal identifiers) or de-identified. If You choose to submit identifiable comments and opinions through Employee Voices, administrators designated by your employer may access and view Your comments and opinions in connection with Your personal identifiers. If You choose to submit de-identified comments and opinions through Employee Voices, Your employer will not be able to directly link your comments and opinions to Your personal identifiers. Note Bambee may be able to link your de-identified comments and opinions to your personal identifiers for quality and safety purposes.
- Device Information. As described in further detail below, We collect information from and about the computers, mobile devices, and other web-connected devices that You use in connection with Our Services, and We combine this information across different devices You use. For example, We use information collected about Your use of Services on Your mobile device to better personalize features associated with Our Services based on the type of computing device You use to access Services. Device information may also include the following:
- Device attributes: Information such as the operating system, hardware and software versions, battery level, signal strength, available storage space, browser type, app and file names and types, and plugins.
- Device operations: Information about operations performed on the device, such as whether a window is foregrounded or backgrounded, or mouse movements (which can help distinguish humans from bots).
- Identifiers: Unique identifiers, device IDs, and other identifiers, such as from games, apps or accounts You use, and family device IDs (or other identifiers unique to Services associated with the same device or Account).
- Device signals: Bluetooth signals, and information about nearby Wi-Fi access points, beacons, and cell towers.
- Data from device settings: Information You allow us to receive through device settings You turn on, such as access to Your GPS location, camera, or photos.
- Server Logs. A server log is a list of the activities that a server performs. Bambee’s servers automatically collect and store in server logs your search queries, Internet Protocol (IP) address, browser type, browser language, the date and time of your request and referral URL and certain cookies that identify Your browser or Bambee account.
- Network and connections. Information such as the name of Your mobile operator or ISP, language, time zone, mobile phone number, IP address, connection speed, and, in some cases, information about other devices that are connected to Services nearby or on Your network, so We can do things like help You locate Shippers and Carriers.
- Cookie data. Data from Cookies stored on Your device, including Cookie IDs and settings. Learn more about how We use Cookies in Our Cookie Policy.
5. How We Use the Information We Collect
We will only use Your personal data when the law allows us to. Most commonly, We will use Your personal data in the following circumstances:
- Where We need to perform the contract We are about to enter into or have entered into with You.
- Where it is necessary for Our legitimate interests (or those of a third party), and Your interests and fundamental rights do not override those interests.
- Where We need to comply with a legal or regulatory obligation.
We will only use Your personal data for the purposes for which We collected it, unless We reasonably consider that We need to use it for another reason and that reason is compatible with the original purpose. If We need to use Your personal data for an unrelated purpose, We will notify You and We will explain the legal basis which allows Us to do so. Please note that We may process Your personal data without Your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.
Bambee uses information collected for the following purposes based on our legitimate interests:
- To communicate with You;
- To administer and protect Our business and the Services including troubleshooting, data analysis, security, testing, system maintenance, support, reporting, technical functionality, hosting of data, and in the context of a business reorganization or group restructuring exercise;
- To prevent and investigate fraud and other misuses of the Services;
- To deliver relevant website content and advertisements to You and measure or understand the effectiveness of the advertising we serve to You;
- To use data analytics to improve Our website, products/Services, marketing, client relationships and experiences; or
- To make suggestions and recommendations to You about products or Services that may be of interest to You.
We also use Your personal data when necessary for the performance of a contract in the following contexts:
- To deliver the Services requested by You as described in the Terms of Service (where applicable);
- To process Your payments, orders, and transactions including:
- Manage payments, fees and charges
- Collect and recover money owed to us;
- To set up and maintain Your account with Us;
- To manage Our relationship with You which will include:
- Notifying You about changes to Our terms or privacy policy
- Asking You to leave a review or take a survey
- Responding to Your questions and inquiries
We may also use Your personal data when necessary to comply with legal obligations.
6. How We Share Your Information
We may share Your information as follows:
- With Other Users. We may share information about You, Your interactions with the Service, Content You post, or other similar information with other Users of Our Services.
- With Other Bambee Services. We may share information about You, Your interactions with the Service, Content You post, or other similar information with other Bambee Services, including those of which You are not a User.
- With Third Parties. We may share information about You with third parties designated by You or with Our service providers, business partners, and other organizations solely for the betterment or functioning of Our service. These third parties are required to protect Your information and are prohibited from using it for third-party advertising or marketing purposes. We ensure that all sharing of information complies with applicable privacy laws and regulations.
- With Service Providers. We may share Your Personal Information with third-parties, such as vendors and service providers who provide assistance with billing, payment processing, marketing, data analytics support and service associated with Our Services, including any provision of goods through Our Services. We do not permit these suppliers and other service providers to access information about You, other than that information necessary for them to complete the services for which they are contracted. Under no circumstances do we allow them to disclose, sell, rent, lend, trade or in any other way transmit data about you to third parties, and we use contractual means to require them to provide appropriate protection for your personally identifiable information and to use it only for the services for which they are contracted.
- With Business Partners and Affiliates. We may share Your Personal Information with our channel partners, subsidiaries, affiliates, and joint ventures solely to fulfill our obligations and requests, and to deliver support. These partners are contractually obligated to provide appropriate protection for your personally identifiable information and use it strictly for the services they are contracted for. Under no circumstances do we permit these partners or affiliates to disclose, sell, rent, lend, trade, or otherwise transmit your data to third parties. User consent is obtained where required, and users retain control over their personal data.
- For Compliance with Laws and for other Legitimate Business Purposes. We may share Your Personal Information when: (i) We believe disclosure is necessary or required by law; (ii) needed to meet Legitimate Business Purposes associated with corporate restructuring, change of control, merger or acquisition; (iii) to protect Users, the integrity of the Service, and/or (iv) to defend or exercise Our legal rights. We may also disclose Your Personal Information when it may be necessary for other legitimate purposes as reasonably determined by Bambee.
- And Generally. We may share information with the general public, such as Your name, username, profile picture, and any Content You post in Our Services.
Bambee may aggregate information collected through the Services and remove identifiers so that the information no longer identifies or can be used to identify an individual (“Anonymized Information”). Bambee shares Anonymized Information with third parties and does not limit third parties’ use of the Anonymized Information because it is no longer personal data.
Bambee may share personal data if Bambee is involved in a merger, sale, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy or other change of ownership or control (in whole or in part). Bambee requires that the shared personal data remain subject to the promises made in the then-current Privacy Policy, unless and until You agree to a new privacy terms.
7. Email Communication
We may send You emails, including marketing, promotional, and third-party related communications. You may opt out of these emails at any time by unsubscribing or selecting this option through Our Services. Note that You may need to opt out from each Bambee Service individually. Despite Your election, We may still be required to send You Service-related communications, including any updates to Our Terms of Service or this Privacy Notice.
8. Public Profile
As an essential element of the Service, most of the information You provide to Us when You register or update Your profile is displayed on Your profile and intended to be shared with other Users, such as Your Employer or other Employees. Your photos, posts, and other Content You post through Our Services are also meant for public consumption. We may display this Content through Our Services. Once displayed on publicly viewable web pages, that information can be collected and used by others. We cannot control who reads Your postings or what other Users may do with the information that You voluntarily post, so it is very important that You do not put any sensitive, confidential, or any other information You do not wish to be shared in Your posts. Once You have posted information publicly, while You will still be able to edit and delete it on the Service, You will not be able to edit or delete such information cached, collected, and stored elsewhere by others.
9. Cookies and Tracking Technologies
We and Our partners, affiliates, analytics, and Service Providers use Cookies or other tracking technologies as pixel tags and web beacons. These are used in order to store content information and preferences, analyze trends, administer and maintain Services, and monitor User interaction with Services. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis. We use Cookies to remember User settings for authentication. Users can control the use of Cookies at the individual browser level. If You reject Cookies, You may still access and use Services, but Your ability to use some features will be fundamentally diminished. These technologies help us better understand user behavior, tell Us which parts of Services Users visited, and facilitate and measure the effectiveness of advertisements and web searches. We treat information collected by Cookies and other technologies as nonPersonal Information. However, to the extent that IP addresses or similar identifiers are considered Personal Information by local law, We accordingly treat these identifiers as Personal Information.
Services may include third-party behavioral advertising. This means that a third party may use technology to collect information about Your use of Our Services so that other parties can provide advertising about products and services tailored to Your interests. If You do not want third parties to collect and use Your information in this manner You may opt-out at the Digital Advertising Alliance in the US.

10. Contact Lists
You may be permitted to upload or import Your contacts, such as employee email lists You wish to join the Bambee Service, to the Bambee Service. When You upload these contacts, You agree You have the rights to upload such contacts and share these contacts with Bambee. We rely upon You to obtain whatever consents from the relevant third-parties that may be required by law to allow Us to access and upload the third-parties’ names, e-mail addresses, and other contact information. You or such a third-party may contact Us at support@Bambee.com to request the removal of this information from Our database.
11. Feedback
We may publish any feedback We receive from You. We may identify You by Your first and last name and may also indicate Your home city. We may post any feedback on the Service from time to time. If You make any comments on a blog or forum associated with Bambee, You should be aware that You have no reasonable expectation of privacy and that any Personal Information You submit there can be read, collected, or used by other Users of these forums, and could be used to send You unsolicited messages. We are not responsible for the personally identifiable information You choose to submit in these blogs and forums.
12. Social Media Widgets
Our Website may include social media features, such as the Facebook button, and/or widgets. These features may collect Your IP address, which page You are visiting on our site and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our site. Your interactions with these features are governed by the privacy policy of the company providing it.
13. Retention, Modification, or Deletion of Your Information
You may change any of Your Personal Information in Your account by editing Your profile within Your account. Generally, Bambee will retain data for as long as indicated in our Document Retention and Destruction Policy found here.
If You would like to cancel Your account or delete Your User Personal Information, You may do so in Your User account, but We may retain and use Your information as necessary to comply with Our legal obligations, resolve disputes, and enforce Our agreements before any such deletion. After an account has been deleted, certain data, such as messages to other Users and comments, will remain. However, We will delete or deidentify Your Personal Information, including Your User name and email address, by associating them with an anonymous User. When We delete any information, it will be deleted from the active database, but may remain in Our archives.
Please refer to our Document Retention and Destruction Policy which provides for the destruction of personally identifiable information after it is no longer needed for the purposes for which it was collected and legal requirements have been met.
14. California Privacy Rights
California Shine the Light Act. Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to request from a business with whom the California resident has an established business relationship, certain information with respect to the types of Personal Information the business shares with third parties for direct marketing purposes by such third party and the identities of the third parties with whom the business has shared such information during the immediately preceding calendar year. To request a copy of the information disclosure provided by Us pursuant to Section 1798.83 of the California Civil Code, You must contact Us at the e-mail or regular mail address specified in the Contacting Us section below with “California Privacy Request” in the first line. Please note that under this law, We are not required to respond to Your request more than once in a calendar year, nor are We required to respond to any request that is not sent to the designated e-mail or mailing address.
California Do Not Track Disclosure. Do Not Track is a privacy preference that some Users may set in their web browsers. When a User turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the User. At this time, We do not recognize or respond to Do Not Track browser settings or signals and We will still receive information. As a result, We may still collect information about You and Your internet activity, even if You have turned on the Do Not Track signal.
California Consumer Protection Act. Pursuant to the California Consumer Protection Act, the following additional disclosures and consumer rights, updated, on an annual basis, apply to California residents who access or use Services:

15. Consumer Rights (erasure, opt out, to know, against discrimination, to access)
Subject to legal requirements (such as our right to retain data for legal proceedings or similar purposes) or obligations in your jurisdiction, verification of Your identity and other information that We may need to honor Your request, You may have the following rights based on the laws in your jurisdiction:
- Right of Erasure. You have the right to request deletion of Your Personal Information.
- Right to Opt-Out. You may request that businesses disclose to you what personal information they have collected, used, shared, or sold about you, and why they collected, used, shared, or sold that information
- Right to Know Whom We Sell or Disclosure Your Personal Information To. You may request that businesses disclose to you what personal information they have collected, used, shared, or sold about you, and why they collected, used, shared, or sold that information.
- Right Against Consumer Discrimination. You have the right to not be discriminated against as a consumer by (a) denial of Services, (b) paying more for Services; and/or (c) receiving lesser quality Services.
- Right to Access. You have the right to request access to or copies of the Personal Information that You provided Us, such as the categories, sources, business purposes, third parties with whom we share such data, and specific pieces of personal information of such data.
You may request the access, correction, amendment or deletion of Your inaccurate personal information by contacting us at support@bambee.com and Bambee will endeavor to respond within forty five (45) days of receipt. In complying with such request, Bambee may ask You to acknowledge and verify Your identity, provide additional detail to assist with Your request, require additional information if You are an authorized agent making the request on someone’s behalf, or other reasonable requests to assist in our compliance efforts. We do not charge a fee to process or respond to Your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell You why we made that decision and provide You with a cost estimate before completing your request. You may also perform such actions in the product, as may be available from time to time.
16. Your Provision of Third-Party Personally Identifiable Information
Certain Bambee Services may allow You to provide third-party personally identifiable information to Bambee, of which You will remain liable for at all times. You represent and warrant You have all rights, permissions, and consents to provide such information to Bambee, and that maintenance of that information, including removal or request for deletion, will at all times be Your responsibility. You will indemnify, defend, and hold Bambee harmless from any third-party actions against Bambee with respect to such third-party personally identifiable information You provide to Bambee pursuant to Our Terms of Service.
17. Third-Party Links
The Services may contain links to third-party websites and services. When You click on a link to any other website, location, or service You will leave Our Services and go to another site or service and another entity may collect data from You. We do not control and are not responsible for such third-party websites or services. 20. Referral Partners
From time to time, Bambee may receive Your information from referrals by third parties, or You may provide your information to third parties for referrals to Bambee and our Services. For customers that are referred to Bambee, Bambee and such referral partner may share customer information during the referral process and after a customer account has been created. Referral Customers are defined as third party employer or employee that joins Bambee via a co-branded advertising, uses a promotion code, or identifies themselves as a customer of partner that was referred by that partner. As a Referral Customer, you acknowledge and consent to Bambee providing to that partner, on a regular basis, basic information about your method of signup, plan type, number of employees, and any additional services you may sign up for. Please consult the referral partner’s privacy policy which you were referred through for further information as to how they may handle your information. We have no liability with respect to third party referral partner usage of your data.

Bambee is committed to protecting the security of Your Personal Information.
